These Terms and Conditions apply to all bookings for Connie’s Academy courses starting on or after 2nd September 2013.

Definitions

In these terms and conditions, the following terms have the meanings set out next to them (and references to the singular include the plural and vice-versa):

  • Agreement: These terms and conditions together with the Enrolment Form and the Price List which are supplied by Connie’s Academy (the Academy).

  • Attendees: Students and Parents of students or children

  • Enrolment Form:  The form you complete and send to the Academy in connection with applying for a place on a Course which shall be considered to form an integral part of this Agreement.

  • Child: A minor under the legal age for whom a Parent or legal guardian is responsible.

  • Course: The Course of study you have applied for on your Enrolment Form as offered by the Academy.

  • Departure Date: The date on which your Course ends

  • Foreign Student: A student resident in a country other than the country where the course is taken

  • Location: Connie’s Academy in Pointe-Noire, 38 Rue de N'DJEBA, Quartier 31 Juillet, Republic of Congo

  • Parent: Parent of legal guardian who is legally responsible for a Child

  • Price List: The document entitled 'Price List' and these terms and conditions and which is also downloadable from the Website and which shall be considered to form an integral part of this Agreement

  • Relevant Account: The Academy's bank account identified on the web site or other document to you.

  • Start Date: The first day of the Course for which you are applying.

  • Website: The Website at www.ConniesAcademy.co.uk

  • You/Your: The Student or Child named in the Enrolment form for a Course at the Academy, or the student who attends a course at the Academy

 

Accommodation

If You are a Foreign Student the Academy will advise You on a variety of accommodation options. You should book accommodation for the Start Date until the day before Your Departure Date unless You are informed to the contrary by the Academy. Accommodation arrangements are Your responsibility unless You indicate on Your Enrolment Form that You wish the Academy to arrange Accommodation for You.

Agreement

This Agreement shall be legally binding between You and the Academy once the Academy has returned to You a signed copy of the completed Enrolment Form from You, whether by e-mail or otherwise, confirming Your place, or Your child’s place, at the Academy. This Agreement and any dispute or claim arising out of or in connection with it or its validity or its subject matter or formation is governed by and construed and interpreted in accordance with the laws of the legal jurisdiction in which the Academy is situated.

Cancellations

Unless a visa to for the country has been denied to You, please note that once the Academy has signed and returned to Your Enrolment form Your Course monies cannot be refunded.  

A full refund of all fees paid (less delivery charges) will be made in the event of visa refusal provided You send written notice to Connie’s Academy and documentary evidence of such refusal.

No refunds will be given on tuition and accommodation if You fail to present yourself at the Academy on the Start Date without having previously cancelled Your Course,

Cancellation of classes

In the unlikely event that classes have not reached the minimum number of students and the Academy decides not to proceed with the class, Students will be notified of the cancellation in not less than 3 business days prior to the start of the Course. See Small classes below for minimum numbers. All efforts will be made to contact students affected in good time to make arrangements. This might include the offer of a free transfer to another course in the same or following Term, or a full refund.

Refunds and transfers

Students and Parents should consider their personal commitments and circumstances before enrolment as we regret that no fees are refundable under any circumstances once the course has started. In the case that numbers are insufficient to proceed with a course and the Academy decides not to proceed with the Course, a full refund will be given.

No refund will be given in respect of students who miss classes, start the course late or leave a course before the end of the Term. It is a student's right and responsibility to attend the number of classes for a given course. Where a student knows that a class will be missed due to prior engagements, we will do our best to assist in communicating the material of that class by telephone, email, or a replacement class where available. Transfers to a future Term will be possible if requested before 5pm Friday in the week preceding commencement of Term. In this case an administrative fee of 15% will be charged. If a course does not run, a student or Parent may transfer to a future course without an administration fee.

Course fees may not be transferred to private classes under any circumstances.

No refunds can be issued for texts or books after they have been collected.

Public holidays

Notice of public holidays are indicated in the Academy's Price Lists. Special courses may be held during the holidays on request.

Changes and Amendments

Once you have started a Course, no changes may be made to it other than by written agreement from the Academy. If the Academy opts to approve a change, the additional charge which is specified in the Price List will be incurred by You, and no change can be effected until full payment has been received.

Conduct

The Academy’s main priority is the well-being and safety of all the Academy’s Attendees. In the case of a Child we ask that Parents collect their charge within 15 minutes of the scheduled finish of their class. Failure to do so could incur additional fees.

You are expected to behave in a courteous manner and to respect fellow students and staff at the Academy. The illegal use of drugs, alcohol abuse and inconsiderate behaviour is unacceptable as is any failure by You to abide by the law and custom of Connie’s Academy’s Location. The Academy reserves the right to withhold Courses and accommodation from any student who fails to meet such standards and to terminate any Course or part thereof without refund in appropriate circumstances. It should be noted that the interior of the building is a designated no-smoking area.

Courses

Start Dates are detailed in the Price List. In the event of an insufficient number of students booking for a particular Course, the Academy reserves the right to cancel the Course or provide You with an alternative Course which the Academy, in its sole discretion, considers suitable. The Academy reserves the right for classes to take place in alternative premises of a similar standard to the Academy.

Competency Levels

Courses are offered at different levels of language learning: Beginners/ Pre-intermediate/Intermediate/Upper Intermediate and Advanced. Other teaching levels may be available by arrangement.

Certification & Attendance

You must attend a minimum of 80% of lessons scheduled for the Course in order to receive a certificate of attendance at its conclusion. Students whose attendance falls below this level may be asked to leave the programme. Students who require visas who fall below the required attendance level may be reported to the appropriate government immigration authority.

Descriptions

The Academy honestly believes that all statements made in promotional material are factual and correct. Every reasonable effort has been made to ensure such accuracy. The Academy is not responsible for any changes that become known after promotional material is produced (up to date information can be found on the Website). The Academy will advise You of any material changes which become known to it prior to the Start Date.

Entrance Test

Where a course requires a minimum level, You may be required to complete and submit an approved test. Failure to do so may result in You being unable to take the course requested. A suitable alternative will be offered.

Expulsion

Committing a criminal offence, insufficient attendance, the provision of false information in Your Enrolment Form, in correspondence and dealings with the Academy prior to the Start Date, disorderly, drunken, aggressive or threatening behaviour or any other actions which could bring harm to the Academy's Attendees, staff or workmen, or bring the Academy into disrepute may result in Your expulsion from the Academy without refund. In such case, relevant authorities will be informed where appropriate.              

Health

You must be in good physical and mental health at the Start Date and the Academy reserves the right to require You to leave any Course at your own expense in the event that it is clear You are unwell or You fail to declare any material matters relating to Your health on the Enrolment Form.

Immigration Regulations

If You are a Foreign Student You must ensure that You fully understand immigration regulations in the Academy’s Location. It is Your responsibility to ensure that You meet and comply with any such regulations and the Academy will not refund any fees paid due to Your having been refused entry into the Academy’s location by immigration authorities.

Insurance and Limitation of Liability

If You are a Foreign student You must arrange suitable insurance in respect of travel and medical risks and You may be required to provide evidence to the Academy of adequate insurance at least seven days before the Start Date or at any point in time thereafter throughout the duration of Your Course.

It is always the responsibility of Foreign Students to satisfy themselves that the provision of insurance is adequate to meet their individual needs. This also applies to students who are supplied insurance whether paid or unpaid as a consequence of booking a course at the Academy.

The Academy shall not have any liability to You for any loss of possessions, injury, death, costs related to medical or dental treatment, or costs related to repatriation or for any other losses, damages (whether direct or indirect), compensation,  costs or expenses unless negligence can be proved in a court of law in the jurisdiction of the Academy.

The Academy shall not have any liability to You for any loss, damage, costs, expenses or other claims for compensation arising from any information or instructions supplied by You which is, or are incomplete, incorrect or inaccurate. Where the Academy incurs costs due to incomplete, incorrect or inaccurate information, You will be liable for these extra costs.

Lesson Times

Indicative lesson times are set out in the Price Lists. Connie’s Academy reserves the right to alter such lesson times at its discretion.

Matters Beyond Connie’s Academy’ Control

The Academy will endeavour to provide You with the Course and service You have booked for. However, we do not take responsibility for disruptions to the Course and arrangements associated with it resulting from forces out of the Academy’s control, such as (but not limited to) earthquakes, other natural disasters, war, governmental action and the like. Refunds in respect of the curtailment of the Course or the period of Your stay in Connie’s Academy’s Location will not be made in such circumstances. All Attendees at the Academy are responsible for their own personal belongings. The Academy will not be held responsible for stolen, lost or damaged items belonging to students.

Payment

Full payment must be received by the Academy not less than 7 days before the course Start Date. You cannot commence Your Course if payment is not made by that time. Payment may be made by bank transfer to the Relevant Account, cheque or in person by cash. Additional charges may apply depending on the choice of payment medium.

Photography, Filming & Sound Recording

During the course of a student’s stay, Connie’s Academy may arrange to record, photograph or shoot video footage for its promotional purposes only, both printed and online. Any student who does not wish to participate should indicate this on their Enrolment Form and state at the time of the recording, photographing or video shooting the wish not to participate.

Prices

All prices stated on the Price List are valid for the period specified on the Price List, which remain in force, unless indicated by a new Price list. Connie’s Academy reserve the right to unilaterally change prices as a result of governmental regulations, tax increases, exchange rate variations or other events.

Academy Closures

The Academy is closed on National holidays. No reductions are made to prices in respect of closures on such dates. Lessons will not be made up except where Private Tuition has been booked.

Academy Rules

Academy rules and regulations are provided at Course inductions by Connie’s Academy and on the Academy website. You must comply with such rules and regulations.

Travel & Transfers

Course fees do not include flights or other transport to the Academy, except where specified. You must make Your own travel arrangements. Connie’s Academy will be pleased to provide information to help You with Your arrangements. Connie’s Academy will offer transfers from Your airport of arrival to Your accommodation (“Transfers”) subject to the payment of an additional charge. You must indicate whether You wish to reserve a Transfer on Your Enrolment Form and provide the Academy with full details of Your flight and arrival time at least 7 days before Your Start Date (failure to do so or any extra costs incurred by the Academy as a result of incorrect, delayed or inadequate information provided by You or Your delayed arrival at the relevant airport may result in You incurring further charges).

Visas

Depending upon the location of Connie’s Academy, You may require a visa to study in such a location. Connie’s Academy will assist You in connection with your initial application for a visa for which the process and costs will be advised to You at least 14 days before the commencement of Your course.

Academy Property

Unless You have purchased Academy texts or books, or have been specifically given material by an Academy teacher, all other Academy material or property, including any student folder maintained by the Academy, is the property of the Academy.
